RELEASE OF LIABILITY WAIVER

By attending class, registering for this website, becoming a Member with an account, and or/using our Services and products, you have agreed and consented to this Waiver.

Yoga provides great benefits, but only you know your own body and limits. Like any exercise, please consult your health care professional with any questions or concerns before starting any exercise program. When participating in any exercise or exercise program, there is the possibility of physical injury. Not all exercises in our videos are suitable for all persons. Ebb & Flow Studio, LLC, which includes all teachers, trainers, videos, classes, programs, marketing materials, and all accompanying materials are not liable for any injury, accident, or health impairment befalling any participant or user of these programs, or any individual utilizing the techniques suggested in the classes or videos.  

Ebb & Flow Studio, LLC is not a licensed medical care provider and represents that it has no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition. Ebb & Flow Studio, LLC makes no representations or warranties with regards to the completeness of information on this website or any linked websites, classes, books, videos, apps, or other products represented herein.

I understand that yoga includes strenuous physical movements. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be eliminated. If I experience any pain or discomfort, I will listen to my body, discontinue the activity, and seek medical attention promptly, and will not return to use of Ebb & Flow Studio LLC until I have medical release.  I assume full responsibility for any and all damages, which may incur through participation.  Waiver includes illness which occurs due to exposure to any and all pathogens, viruses, and/or infection including COVID 19 and variants.

Yoga is not a substitute for medical attention, examination, diagnosis, or treatment. Yoga is not recommended and is not safe under certain medical conditions. By signing, I affirm that a licensed physician has verified my good health and physical condition to participate in such a fitness program. In addition, I will not participate if I have a health condition for which this program is not advisable and will consult my physician. If I am pregnant, become pregnant, or I am post-natal or post-surgical, my acceptance of these terms when I registered, and that I am attending either online or in-person, verifies that I have my physician approval to participate.

I also affirm that I alone am responsible to decide whether to practice yoga and participation is at my own risk. I hereby agree to irrevocably release and waive any claims that I have now or may have hereafter against Ebb & Flow Studio, LLC and the facility location in which I am participating at 5330 S Racine Avenue, New Berlin WI, and all instructors.

I have read and fully understand and agree to the above terms of this Liability Waiver Agreement. I am signing this agreement through my acceptance of terms and conditions voluntarily, by attending a class, or by using products, services, and instructors of Ebb & Flow Studio LLC, and recognize that this serves as complete and unconditional release of all liability to the greatest extent allowed by law in Wisconsin and any state of the United States of America in which I am participating in classes, videos, and products.

Classes and videos include activities related to Yoga, Barre, Pilates, and physical fitness.  All activities I perform related to products, classes, videos, and other associated items are covered by this waiver for Ebb & Flow Studios, LLC and its locations.
